The American Civil Liberties Union (ACLU) of Virginia, on behalf of individual plaintiffs, is suing the School Board of Giles County, Virginia, over a display that contains the Ten Commandments as one of eleven historic documents.

Liberty Counsel will represent the school board on Monday, May 7, in the summary judgment hearing. I am calling on the Liberty Counsel team for prayer – Mat.


The ACLU of Virginia sued the Giles County School Board after the Board adopted an “open forum” policy, which permits the display of historical documents by private individuals or groups.


A privately-sponsored historical display consisting of eleven documents, one of which is the Ten Commandments, was posted in Narrows High School (Narrows is a small community near the West Virginia border, not too far from Blacksburg and Virginia Tech).

The additional ten documents in the “Foundations of American Law and Government” display include such items as the Magna Carta, the Declaration of Independence, and the Mayflower Compact.

The purpose of the display is simply to teach the historical foundation of American law.

An “offended” parent and student have partnered with the ACLU to have the display of the Ten Commandments removed – even though the Ten Commandments is listed in Virginia’s secular schoolbooks as being among the core contributing principles of several civilizations, including the Hebrew people, and among the foundational elements of our own laws and government.

The ACLU has done everything it could to run from the facts and the law that control this case!

The “Foundations of American Law and Government” display has been upheld by multiple federal courts of appeal. It is clearly appropriate to include the Ten Commandments in a display on law, because there is no dispute that this ancient code helped shape American law and government.

The display in question includes a composite of 20 documents and pictures and reflects the approved curriculum for Virginia schools, which is clearly constitutional.

As Liberty Counsel’s lead constitutional attorney, I will argue in federal court on Monday in defense of the Giles County School Board.

M., I’m asking you to do two things right now…

++The ACLU is a daunting, deep-pocketed adversary.

Amazingly, the ACLU spent over 100 million dollars on their misguided mission last year alone!

By way of contrast, Liberty Counsel spent less than 4% of that amount advancing liberty, life and family in 2011. Yet, by God’s grace, we had several major triumphs over the ACLU during that time and no losses!

As I’ve said many times before, the ACLU has an enormous war chest – far larger than their single-year expenditure in 2011 – and a formidable army of seasoned litigators. They can (and usually do) put a lot of “boots on the ground” when they want to bully a local school system into submission!

++America has badly strayed from our original course.

As I mentioned in my message on the National Day of Prayer yesterday, our nation was founded upon Christian principles by men and women who held God’s Word, including the Ten Commandments, in high esteem – and America prospered as a result.

Tragically, I believe America has all but turned from its Christian founding and has left behind its rich heritage of godly leadership. I believe our country is experiencing the consequences of a severe moral decline that only God can correct…

But even in these perilous times, and in this season of increasing radicalism, we, the people of God, can once again turn to Him – and call on Him to heal and restore our land!

That is why I am calling all Americans who stand with Liberty Counsel to commit to pray in this pivotal year that will literally determine the course of our nation – from Thursday, May 3, to Tuesday, November 6, 2012.
